Tree Maintenance and Removal

When a Tree Related Permit Is Required

Maintenance: If you are planting, treating, or pruning trees and will be occupying right-of-way space for more than thirty minutes, you must submit a Temporary Encroachment Permit.

Removal: A tree removal permit application is required when any of the proposed tree removals are within the city limits of Aspen and meet any of the following size thresholds:

  • Woody shrubs that contain stems that are 3 inches and greater in diameter.
  • Coniferous trees that are 4 inches and greater in diameter.
  • Deciduous trees that are 6 inches and greater in diameter.

Choosing the Correct Tree Removal Permit Type

A Standalone Tree Removal Permit is used for the removal of declining, hazardous, or standing dead trees. You must use a standalone tree removal permit if:

  • Tree removal or maintenance is not associated with development, and
  • There are no plans to submit a building or development permit for the property within the next three (3) years.

A Development-Related Tree Removal/Critical Root Zone Excavation Permit is required when tree removal is connected to current or planned development on a property. This allows tree impacts to be reviewed in the context of the full project and ensure trees are properly considered during site planning and construction. You must use a development-related tree removal permit if:

  • A building permit, demolition permit, grading permit, or other development approval will be submitted for the property now or within the next three (3) years, or
  • The proposed tree work is needed to support site design, construction access, utilities, foundations, or other development-related improvements, or
  • Tree removal or pruning is part of a larger redevelopment, expansion, or change in land use.

Funds collected through tree mitigation are reinvested directly into Aspen’s urban forest. These dollars support the planting of new trees, the care and maintenance of existing trees, and long-term forest health projects within City parks and public rights-of-way. Your contribution helps ensure Aspen’s tree canopy remains vibrant, resilient, and well cared for.

After you submit an application, the City Forester or permit coordinator will complete a site visit to assess your trees. Mitigation for development related permits may be made in one or more ways:

  • Replace the same value in trees back on the site,
  • Pay the value as cash-in-lieu to the City, or
  • A combination of the above.
